Simple Process

How it works

Arrange while you have capacity

A Lasting Power of Attorney must be set up while you still have mental capacity. It cannot be created after capacity is lost — so acting now is essential.

Choose your attorney

Select the person you trust most to make decisions on your behalf. This could be a family member, close friend, or professional.

Decide when it takes effect

You choose whether your attorney can act right away, or only if you lose capacity. You remain in control of the terms.

Register with the OPG

Joel D. Kerr Funerals registers the Power of Attorney with the Office of the Public Guardian on your behalf — there is nothing further for you to do.

Your Lasting Power of Attorney is not valid until it is registered with the Office of the Public Guardian (OPG). It cannot be registered after loss of capacity — which is why it is essential to act now, while you are able to.
